1) Introduction

By accessing the Website, booking an appointment, receiving Services, or communicating with us, you agree to be bound by these Terms. If you do not agree, do not use the Website or Services.

2) Eligibility

You must be 18 years of age or older to use the Website or receive Services. By using the Website, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

3) Service Area

Black Diamond provides Services exclusively within the State of Texas. We make no representation that the Website or Services are appropriate or available outside Texas.

4) Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Changes become effective upon posting to the Website. Your continued use of the Website or Services after such changes constitutes acceptance of the revised Terms.

5) Appointments, Cancellations & Rescheduling

5.1 Appointments

Appointments may be scheduled through the Website, booking tools, or direct communication.

5.2 Cancellations & No-Shows

  • Same-day cancellations are allowed.

  • No no-show fees are currently charged.

5.3 Rescheduling

We maintain a flexible rescheduling policy. Repeated last-minute reschedules may result in future booking limitations at our discretion.

6) Pricing, Payment & Refunds

6.1 Payment Timing

Payment is due after Services are completed, unless otherwise agreed in writing.

6.2 Payment Processor

Payments are processed through Square or other approved payment methods. We do not store payment card details.

6.3 All Sales Final

All sales are final. No refunds are issued once Services have been performed, except where required by law or expressly agreed to in writing by the Company.

6.4 Chargebacks

You agree to contact us directly to resolve any concerns before initiating a chargeback. Unauthorized chargebacks may result in denial of future services.

7) Warranties & Satisfaction Policy

7.1 Window Tint Warranty

We provide a lifetime warranty against:

  • Bubbling

  • Peeling

  • Discoloration

This warranty does not cover damage caused by accidents, abuse, aftermarket modifications, improper care, or third-party repairs.

7.2 Vinyl Wrap & Paint Correction

  • Paint correction services are provided “as-is.”

  • Results depend on vehicle condition, paint history, and material integrity.

  • No guarantee is made regarding permanent correction or durability.

7.3 Satisfaction Remedy

If you are dissatisfied, our sole obligation is to re-do the affected section or issue a service credit, at our discretion. Refunds are not guaranteed.

8) Vehicle Condition & Risk Disclosure

By booking Services, you acknowledge and agree that:

  • Vehicles may have pre-existing defects, including but not limited to weak clear coat, prior repainting, rust, brittle trim, or aftermarket parts.

  • Some materials or finishes may fail during or after service due to age or condition.

  • Black Diamond is not responsible for pre-existing damage or failures resulting from such conditions.

  • Personal items left in the vehicle are the owner’s responsibility.

  • Electronic systems, sensors, alarms, or accessories may behave unpredictably; Black Diamond is not liable for manufacturer defects or failures.

9) Photos & Marketing Use

You grant Black Diamond the irrevocable right to photograph or video your vehicle before, during, and after Services and to use such media for marketing, advertising, portfolio, and promotional purposes, without compensation or further consent.

10) User Reviews & Submissions

Users may post reviews or feedback. By submitting content, you grant Black Diamond a non-exclusive, royalty-free, perpetual license to use, display, reproduce, and distribute such content for business purposes.

You agree not to post unlawful, defamatory, misleading, or abusive content. We reserve the right to remove content at our discretion.

11) SMS/Text Messaging Terms

By providing your phone number and opting in, you consent to receive transactional and marketing SMS messages, including appointment reminders and promotions.

14) Limitation of Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE GIVING RISE TO THE CLAIM OR $100, WHICHEVER IS GREATER.

15) Indemnification

You agree to indemnify and hold harmless Black Diamond Details LLC from any claims, damages, losses, or expenses arising from your use of the Website or Services, including violations of these Terms.

16) Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

17) Mandatory Arbitration & Class Action Waiver

YOU AGREE THAT ALL DISPUTES SHALL BE RESOLVED BY BINDING ARBITRATION AND NOT IN COURT.

  • Arbitration shall occur in Lubbock County, Texas

  • Arbitration administered by the American Arbitration Association (AAA)

  • No class actions or collective proceedings permitted

  • You waive the right to a jury trial

If any portion of this section is found unenforceable, the remainder shall remain in effect.

18) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control, including weather, acts of God, labor shortages, power outages, or government actions.

19) Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Black Diamond Details LLC.
